1. Acceptance of these Terms

These Terms of Service (the "Terms") form a binding agreement between you and Tarim (the "Company", "we", "us" or "our") regarding your access to and use of the Tarim website, software, automated trading tools, analytics and related services (together, the "Platform"). By creating an account, accessing the Platform or using any of its features, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy and Risk Disclosure. If you do not agree, you must not use the Platform.

2. Eligibility

You may use the Platform only if you are at least 18 years old, have full legal capacity to enter into a contract, and are not prohibited from doing so under the laws of the United Kingdom or any other jurisdiction that applies to you. You must not use the Platform if you are subject to sanctions or are located in a country where the use of crypto assets or the Platform is restricted. You are responsible for ensuring that your use of the Platform complies with all laws that apply to you.

3. Your account

You must provide accurate, current and complete information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials, passwords and any two-factor authentication devices. You must notify us without undue delay at [email protected] if you suspect unauthorised access to your account. You are responsible for all activity carried out through your account, whether or not you authorised it, unless the loss results from our breach of these Terms.

4. Description of the services

The Platform provides tools that may include automated trading bots, market analysis for major assets such as Bitcoin and Ethereum, portfolio dashboards and configurable risk controls. We may add, change or remove features at any time. Certain features may be offered only in part of the Platform or only to users who meet additional requirements. We do not guarantee that the Platform will be uninterrupted, error-free or compatible with every device or third-party service.

5. No investment advice

Information, signals, calculators, projections and commentary made available through the Platform are provided for general educational purposes only. They do not constitute personal financial, investment, legal or tax advice, nor an offer or solicitation to buy or sell any asset. Any simulated or illustrative results are hypothetical. You are solely responsible for your own trading decisions and should seek independent professional advice where appropriate.

6. Risks

You acknowledge that crypto assets are highly volatile, that automated tools can fail or behave unexpectedly, and that you may lose some or all of the funds you commit. Past performance is not a reliable indicator of future results. Please read our Risk Disclosure carefully before using any trading functionality.

7. Fees and payments

Any fees, performance charges or subscription prices applicable to the Platform will be displayed before you commit to them. Unless stated otherwise, fees are exclusive of VAT or any other applicable taxes, which you are responsible for paying where required. Third-party network fees, exchange charges and spreads are not controlled by us and may apply in addition. Payments made to us are generally non-refundable except where required by law or expressly stated in these Terms.

8. Acceptable use

You agree not to misuse the Platform. In particular, you must not attempt to gain unauthorised access to any system or account, interfere with the security or operation of the Platform, reverse engineer or copy our software except as permitted by law, use automated means to scrape content without our consent, submit false information, engage in market manipulation, money laundering or any other unlawful activity, or use the Platform to infringe the rights of others.

9. Intellectual property

All content on the Platform, including text, graphics, logos, trademarks such as "Tarim", software and data compilations, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial purposes. No other rights are granted.

10. Third-party services

The Platform may link to or integrate with third-party exchanges, wallets, payment providers and data sources. We do not control these services and are not responsible for their availability, accuracy, security or conduct. Your use of third-party services is governed by their own terms and policies.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any loss of profit, loss of capital arising from market movements, loss of data, indirect or consequential loss, or losses arising from your trading decisions or the actions of third parties. Our total aggregate liability to you for any claim relating to the Platform shall not exceed the fees you paid to us in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law. Your statutory rights as a consumer, where applicable, are not affected.

12. Suspension and termination

We may suspend or terminate your access to the Platform with or without notice if we reasonably believe you have breached these Terms, pose a security risk, or are required to do so by law or regulation. You may close your account at any time by contacting us. On termination, your right to use the Platform ends immediately, although provisions that by their nature should survive, including those on liability, intellectual property and governing law, will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. We will publish the revised version on this page, update the "last updated" date and, where changes are material, notify you through the Platform or by email. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any dispute arising out of or in connection with them, without prejudice to any mandatory rights you may have as a consumer to bring proceedings in your place of residence. We encourage you to contact us first so that we can try to resolve any concern informally.
